Terms and Conditions

These terms apply to all services of Uncapped Recruitment, De Stuwdam 5, 3815 KM Amersfoort, hereinafter “Uncapped”. There are separate provisions for candidates and for clients.

Part A: candidates

1. Free of charge

Our services are free for candidates. You pay nothing for the job check, the advice call, the guidance or the placement. The client pays our fee.

2. No obligation

You are never obliged to accept a proposal. We only put you forward to an employer once you’ve agreed to it.

3. Correct information

You ensure that the information you give us is correct and complete, including your qualifications, experience, certificates and driving licences. You let us know if you’re already in conversation with the same employer through another route.

4. Hired directly by the employer

We only place candidates into an employment contract directly with the employer. Uncapped is not a temp agency and does not become a party to your employment contract.

5. Privacy

The processing of your data is subject to our privacy statement.

Part B: clients

6. Assignment

An assignment comes into effect through written confirmation from Uncapped, including by email. Uncapped has a best-efforts obligation, not an obligation of result.

7. Fee

The client owes a placement fee as soon as a candidate put forward by Uncapped enters into an employment contract with the client or a company affiliated with it, even if this happens within twelve months of the introduction and outside of Uncapped. The amount of the fee is stated in the assignment confirmation.

8. Probation period

If the employment contract ends during the probation period, Uncapped does not invoice the full fee. The settlement is set out in the order confirmation. Uncapped is not obliged to search for a replacement candidate free of charge.

9. Payment

Invoices are paid within fourteen days of the invoice date. In the event of late payment, statutory commercial interest is owed and collection costs are for the client’s account.

10. Confidentiality

Data on candidates put forward by Uncapped is confidential and is not shared with third parties. The client is not permitted to refer a proposed candidate to a third party.

11. Liability

The client is responsible for the final selection and for checking references, qualifications and identity. Uncapped’s liability is limited to the amount of the fee for the relevant assignment.

Part C: general

12. Applicable law

Dutch law applies to these terms. Disputes are submitted to the competent court in the district where Uncapped is based.

13. Changes

Uncapped may amend these terms. The version on the website applies at the time of the assignment or registration.
